Mandatory Energy Audits?

Governor Ted Kulongoski of Oregon is proposing a program that would require all buildings sold in the state to be tested and rated for energy efficiency.  The plan would take effect in 2011 for houses and 2012 for commercial buildings.

“With escalating energy prices, a homeowner or small business person has a right to know the energy performance of a home or building they invest in,” reads a draft of the bill provided by the governor’s office.  This quote points out the positive aspects of such a program.  It would provide incentives for new buildings to be built more efficiently, as they would qualify for special funding programs and would be more attractive to potential buyers.

There are some problems with the plan, however.

Older homes and buildings, which abound in Portland, would be rated lower than buildings built with new technologies and materials.  The good news is, many of these homes and buildings could be updated with windows and additional insulation, and would have greatly improved efficiency numbers.  This puts an additional burden on the seller, possibly, unless the buyer was willing to look past the less efficient building and purchase it for its historical character or some other reason.

The other problem with the plan is that there is no designated measurement tool to determine the efficiency of buildings.  Several programs are available, including the national Energy Star tool, and a local program called Earth Advantage.  Both programs require buildings to be at least 15% more efficient than code. 

The Energy Trust of Oregon is currently conducting a pilot project with 200 homes using the Earth Advantage certification program.  The aim of the project is to find the least expensive and quickest way to provide energy audits and provide certification to building owners.  Results are expected at the beginning of the new year.

“Hopefully this program will serve as a model for the state and the country,” said Kendall Youngblood, a residential sector manager for the Energy Trust. “We’re designing it as an education piece for the homeowner, so they start to understand homes are associated with carbon emissions.”

US Fed News Service, Including US State News July 11, 2009 ALBANY, N.Y., July 9 — The U.S. Department of Justice’s Federal Bureau of Investigation Albany Field Office issued the following press release:

Andrew T. Baxter, United States Attorney for the Northern District of New York, announces that ANDREW WYMES, a/k/a Drip, age 29, Utica, New York, pled guilty today in U.S. District Court in Syracuse to charges relating to his role as a leader of a Utica-based drug trafficking gang.

As part of his plea, WYMES pled guilty to an Indictment charging him with conspiracy to distribute and possess with intent to distribute cocaine. He also pled guilty to an Information charging him with using and carrying a firearm during and in relation to a drug trafficking crime. At sentencing, which is scheduled for November 10, 2009, WYMES faces a minimum of 15 years imprisonment, a maximum of life imprisonment, up to $4,250,000 in fines and 8 years of supervised release following any period of incarceration.

As part of his plea WYMES admitted to selling between 2 and 3.5 kilograms of cocaine to mid-level dealers in the Utica area, and possessing a .45 caliber handgun in furtherance of his drug trafficking activity. website 2004 acura tl

The case against multiple co-defendants remain pending at this time.1 The prosecutions resulted from an investigation undertaken by the Federal Bureau of Investigation, The Drug Enforcement Administration (“DEA”), the New York State Police, Special Investigations Unit and the Oneida County Drug Task Force, which is comprised of agents from the Utica Police Department, the Oneida County Sheriff’s Department, the Rome Police Department, and the New Hartford Police Department. The U.S. Marshal’s Service assisted in the arrests today.

To date, the following items have been recovered during this investigation: approximately $23,000 in U.S. currency; more than half a kilogram of cocaine; approximately 125 grams of crack cocaine; four handguns; and three long-barreled firearms. Agents have also seized the following nine vehicles, all of which are alleged to have been used to facilitate the organization’s drug trafficking activities: (1) 2004 Acura TL; (2) 2005 Mitsubishi Endeavor; (3) 2003 Honda Accord; (4) 2004 Honda Accord; (5) 2002 Chevy Trail Blazer; (6) 2005 Jeep Cherokee; (7) 2002 Ford Explorer; (8) 2004 Mercedes-Benz; and (9) 2005 Acura TL.

My client, the American Institute of Architects (AIA), is asking people to visit their YouTube channel (http://www.youtube.com/user/AIANational) and comment on some of the plans their colleagues have asked President-elect Obama to consider as he continues to roll out the terms of his economic recovery plan, which includes a large push for energy-efficient infrastructure.

Back in late 1970s, the Carter Administration enacted legislation that would have required mandatory federal energy audits for all buildings and development of federal energy efficiency standards for existing buildings (then known as weatherization). Unfortunately, these programs were abolished in Reagan Administration. Glad to see we are reconsidering this approach.

    I would propose an national phased-in approach similar to the UST program where buildings of certain vintage have to adopt efficiency upgrades beginning with oldest buildings.
